COOKING EQUIPMENT WARRANTY

STANDARD WARRANTY

Asber warrants its new cooking equipment (“Equipment”) to be free from defects in material and workmanship for a period of one (1) year from the original date of installation, not to exceed fifteen (15) months from the date of shipment from the factory. On Emerald Gas countertop line Two (2) years from the original date of installation, not to exceed twenty-seven (27) months. This warranty applies only to products sold to and installed by the original commercial end-user purchaser. It is non-transferable and does not apply to any unit installed for residential use or outside the continental United States. Any such installation immediately voids the warranty.

Fryer Warranty

For commercial fryers, Asber provides a one-year parts and labor warranty along with a limited two (2) year tank warranty. If the fryer tank develops a leak due to a verified manufacturing defect within two years of installation, and the defect is confirmed by an Asber-authorized service provider, Asber will replace the fryer. This coverage does not include freight or installation costs related to the replacement.

The liability of Asber is limited, at its option, to the repair or replacement of any component found to be defective in material or workmanship under warranty terms. Asber will bear the cost of straight-time labor for the installation of warranty-covered parts, provided the work is performed by Asber or an authorized service agent. The warranty includes a maximum of two (2) hours of round-trip travel time or 100 total miles of road travel. This allowance does not include after-hours, weekend, or holiday labor; air or ferry travel; remote location surcharges; or any expenses beyond these limits without prior written authorization. Asber is not responsible for relocating a unit from the user’s premises to perform a warranty repair.

Asber warrants all new machine parts manufactured or authorized by Asber to be free from defects in material and workmanship for a period of ninety (90) days from the Warranty Commencement Date. If a defect is confirmed within this period, the part will be replaced at no charge. Replaced parts become the property of Asber.

All claims must be submitted promptly and must include the model number, serial number, manufacturing date, installation date, proof of purchase, and full documentation of the claimed defect. Asber reserves the right to inspect the equipment at the user’s premises to verify the existence and cause of any defect and to determine eligibility for warranty coverage. Claims must be made within the applicable warranty period; late claims will not be accepted.

Commercial Use Only—Not for Household Applications: Any installation or use of this equipment in a household or non-commercial setting immediately voids all warranty coverage. The unit will be deemed sold “as-is, where-is,” and Asber will have no liability for any claims under such conditions. Service providers may refuse warranty repairs in residential environments, and all costs in those cases are the responsibility of the owner.

This warranty does not cover damage or failure resulting from improper installation, unauthorized alterations, modification from original design, or installation not performed in accordance with Asber’s instructions or by an authorized agent. Also excluded are damages caused by misuse, abuse, negligence, hard chemicals, lack of required maintenance, or exposure to unstable gas or electrical supply. The warranty does not cover costs related to calibration, adjustment, or routine maintenance such as lubrication or air/gas tuning, which are the sole responsibility of the owner, dealer, or installer.

Additional exclusions include, but are not limited to: thermostat calibrations beyond thirty (30) days from installation; air and gas adjustments; burner flame or pilot cleaning; failures caused by erratic voltage or gas supply; broken capillary tubes; ordinary wear and tear; unauthorized service by non-Asber technicians; damage in transit; alteration or removal of the serial number; and any claim resulting from Acts of God or natural disasters.

This warranty is the sole and exclusive warranty offered by Asber with respect to its cooking equipment and is in lieu of any other express or implied warranties, whether written or oral. Asber expressly disclaims all other warranties, including any implied warranties of merchantability or fitness for a particular purpose. Asber shall not be liable for loss of revenue or profit, loss of use, substitute performance, or for any incidental, special, indirect, or consequential damages of any kind, regardless of the legal theory under which such damages are sought. The exclusive remedy under this warranty is limited to the repair or replacement of defective parts, as specified above.

To validate warranty coverage, users must register their equipment online at: www.asberamerica.com. Warranty service requests must be submitted to the ONNERA USA Service Department by calling 877-693-3372 or by emailing us.service@onneragroup.com. All claims must include the model number, serial number, manufacturing date, date of installation, proof of purchase, and supporting documentation for the defect. Claims for fryer tanks must include confirmation by an authorized service company.

Asber assumes no responsibility for visible or concealed damage sustained during transit. It is the user’s responsibility to inspect all deliveries for damage before accepting the shipment. If any damage is observed, the packaging must be opened in the presence of the carrier and the damage must be noted on the carrier’s receipt. All crating materials must be retained for inspection.

Cancelled orders and returned merchandise are subject to a 25% restocking and handling fee. No returns will be accepted without prior written authorization. All returned equipment must be in its original factory crate, must be in new and unused condition, and must be returned freight prepaid. All returns must be requested within thirty (30) days of the invoice date.
